Welcome to Pure Motion Apparel. By accessing or purchasing from our website, you agree to the following Terms of Service. These terms are legally binding and apply to all users, customers, and visitors.
1. ACCEPTANCE OF TERMS
By using this website and/or placing an order, you confirm that:
- You have read, understood, and agreed to these Terms of Service
- You are at least 18 years old or have permission from a legal guardian
- You agree that checking the Terms & Conditions box at checkout serves as your electronic signature
2. PRODUCTS & SERVICES
Pure Motion Apparel sells:
- Custom graphic design services
- Physical apparel and DTF-related products
- Digital products (including ebooks, guides, and downloadable files)
All product descriptions and pricing are subject to change at any time without notice.
3. DIGITAL PRODUCTS (STRICT NO REFUND POLICY)
All digital products are non-refundable and non-returnable.
By purchasing any digital product, you agree that:
- You will receive instant or near-instant access upon payment confirmation
- Delivery is considered completed once the download link is sent to your email or shown on screen
- You waive any right to disputes, chargebacks, or refunds after receiving access
Failure to download or access your product does not qualify for a refund.
Unauthorized sharing, reselling, or redistribution of digital products is strictly prohibited and may result in legal action.
4. SHIPPING POLICY (PHYSICAL PRODUCTS)
- We ship within the United States only
- Orders are processed within 1–2 business days (excluding weekends & holidays)
- Shipping is handled via USPS and typically takes 1–3 business days after shipment
Once your order is shipped:
- A tracking number will be sent to your email
- We are not responsible for delays caused by USPS
5. ADDRESS ACCURACY
Customers are responsible for entering the correct shipping address.
- If an incorrect address is provided, we are not responsible for lost packages
- Address changes must be requested before the order is shipped
- If a package is returned, customers must pay for reshipping
6. DELIVERY CONFIRMATION & LIABILITY
Once tracking shows “Delivered”, the order is considered fulfilled.
- Pure Motion Apparel is not responsible for lost or stolen packages after delivery confirmation
- Customers should contact USPS directly for delivery issues
7. RETURNS & REFUNDS (PHYSICAL PRODUCTS)
- Returns are only accepted within 6 days of delivery
- Items must be returned unused and in original condition
- Customers must return ALL items from the order to qualify
Partial returns will not be accepted for refunds.
Failure to return all items voids refund eligibility.
8. CHARGEBACK & FRAUD POLICY
By placing an order, you agree:
- You will contact us first to resolve any issues before filing a chargeback
- Filing a false chargeback after receiving products or digital goods is considered fraud
We actively fight all chargebacks using:
- Order confirmations
- IP address verification
- Payment authorization records
- Email communication logs
- Delivery tracking proof
- Digital download timestamps
Fraudulent disputes may result in:
- Permanent ban from our store
- Submission of evidence to payment processors
- Legal action where applicable
9. INTELLECTUAL PROPERTY
All designs, graphics, content, and products are owned by Pure Motion Apparel.
You may not:
- Copy, reproduce, or resell our designs
- Use our content for commercial purposes without permission
10. ORDER COMBINING
Orders placed with the same shipping address may be combined into one shipment at our discretion.
11. LIMITATION OF LIABILITY
Pure Motion Apparel is not liable for:
- Shipping delays caused by carriers
- Lost or stolen packages after delivery confirmation
- Misuse of products
- Customer errors (wrong address, incorrect order details)
12. MODIFICATIONS
We reserve the right to update or modify these Terms at any time without prior notice.
